The tax rules behind gold IRAs, from the statute up

Every rule explained from the source document — IRC §402(c), §72(t), §408, Pub 590-A/B — not from a sales script: the 60-day clock, the 10% additional tax, RMDs, distribution taxes and the Roth mechanics. What triggers a tax bill, what never does, and the exact step where people slip.

No sales scripts

Five pillars. Public before publication. Statute or nothing.

Most gold IRA tax pages exist to move you toward a phone call. Ours exist to state the rule and show the source: the IRC section, the IRS publication, the check date. Where a dealer makes a tax claim, we quote the statute instead — and where a question needs a licensed professional, the guides say so.

What every guide is verified against
PillarWeightWhat we verify
Primary-Source Basis30%Every rule traces to the IRC section or IRS publication that decides it — §402(c), §72(t), §408, Pub 590-A/590-B — never to a dealer blog.
Check Dates & Currency20%Dollar limits, ages and thresholds carry the date they were verified; IRS figures change and stale numbers are marked, not silently reused.
Trigger Mechanics20%Each penalty page states what triggers it, what does not, and the exact step where people slip — the difference between a transfer and a taxable distribution.
Forms & Paperwork15%The forms that carry each rule — 1099-R, 5329, 5498, 8606 — named in context, with the boxes and codes that matter.
Neutrality15%No promised outcomes, no "tax-free" without conditions, no dealer scripts. Where a question needs a licensed professional, the guides say so.

Tax questions, answered without a phone call

How is a gold IRA taxed?
A traditional gold IRA grows tax-deferred: distributions at withdrawal are taxed as ordinary income. A Roth gold IRA grows tax-free: qualified withdrawals pay nothing. Inside either account, selling one metal for another is not a taxable event — the tax bill arrives when money (or metal) leaves the account. Our reference guide walks through each rule with the IRC section behind it.
What is the IRS 60-day rollover rule?
If money from a retirement account is paid to you first, you have 60 days to redeposit it into the new IRA or it becomes taxable, plus a 10% additional tax if you are under 59½. Only one indirect IRA-to-IRA rollover is allowed per 12-month period. A direct custodian-to-custodian transfer skips the clock entirely — that is the path our 60-day rule guide explains.
What is the early withdrawal penalty on a gold IRA?
Taking money out before age 59½ generally adds a 10% additional tax under IRC §72(t) on top of ordinary income tax on a traditional IRA distribution. The statute lists the exceptions — death, disability, substantially equal periodic payments, first-home purchase, and others — in our early withdrawal guide.
Do gold IRAs have required minimum distributions?
Traditional gold IRAs do; Roth IRAs do not while the original owner lives. A distribution can be taken in cash or, if the custodian allows, in kind — as metal shipped to you at its fair market value. Missing an RMD carries an excise tax, which our RMD guide details with the current age thresholds.
Are gold IRA "tax loopholes" real?
Some are real rules dressed up in marketing language: direct transfers, Roth conversions, qualified charitable distributions, §72(t) payment plans. Others — like schemes to store IRA gold at home through an LLC — are prohibited transactions that can disqualify the entire account. Our loopholes guide separates the two, with the section numbers that decide each.
How do you verify the rules on this site?
Every rule traces to the IRC section, Treasury regulation, or IRS publication that decides it — never to a dealer blog. Figures carry a check date (currently October 2026); the full method is on the methodology page. We do not give individualized tax advice and say so where it matters.
